Limitation of Liability limits the amount as well as the types of damages a party can recover from the other in the contract.
This is an efficient way to cap the liability amount undertaken by a party, the exposure is capped at the fees paid to the service provider under the agreement or another small amount which may be more or less than the fees.
The General Liability Cap is the single cap on direct damages except for the cap identified as a supercap, i.e. more than one cap for multiple claims. In the contract if there is a single cap for all liability claims then that cap will be considered as General liability cap. |
